1. Purpose

The present GCS govern the contractual relations and the conditions applicable to any purchase carried out by the means of the merchant site www.almeparis.com between: any person, private individual or company, acting only in the capacity of consumer and strictly for its personal needs, visiting or carrying out a purchase via the Internet site www.almeparis.com; hereafter called "the customer".

The customer declares to have taken knowledge of the present GCS.

1. The fact of placing order on the site www.almeparis.com implies the whole adhesion and without reserve of the customer to the present General Conditions of Sale. All the sales carried out on this site are exclusively made in accordance with the present General Conditions of Sale.

2. Stipulations or conditions included in the customer's order which are in any way incompatible with these GTC, or which are added to them, shall not be binding on ALME and shall not be applicable, notwithstanding ALME's acceptance of the order. The fact that ALME does not object to the stipulations contained in any communication received from the customer shall not be considered as a waiver of the present GTC.

3. The present GTC shall prevail over any other general or particular conditions not expressly approved by ALME. ALME reserves the right to modify its GTC at any time. In this case, the modifications will be applicable to the sales contracted as soon as the modified GCS are put online on the site.

2. Characteristics of the proposed goods

The products offered for sale online are those presented on the site www.almeparis.com

The products are described and reproduced by ALME on the site with the greatest possible accuracy. However, ALME draws the customer's attention to the fact that the photographs cannot ensure a perfect similarity with the product offered for sale, particularly with regard to colors.

The differences may result from the color quality of the photographs, the difficulty of rendering the materials on the screen or, without being exhaustive, the technical adaptation. These differences cannot be interpreted as defects of conformity and lead to the cancellation of the sale.

In the event of an obvious error or insignificant omission between the characteristics of the product and its representation and/or description, ALME shall not be held liable. Product offers and prices appearing on the site are valid as long as they appear on the site, within the limits of available stocks.

In the event that a product is unavailable, ALME undertakes to inform the customer as soon as possible by e-mail or telephone and to indicate, if necessary, the estimated waiting time for delivery of the product.

The customer will be able to confirm his order or request a refund of the product on the basis of the invoiced price.

  • The preparation and delivery costs will be refunded to the customer if the latter confirms the cancellation of the entire order.
  • The preparation and delivery costs will remain at the customer's expense if the customer confirms the delivery of one or more other available products that are part of the same order.

3. Awards

The prices of the products offered for sale on the site www.almeparis.com are expressed in euros, including VAT and are valid only on the site. Preparation and delivery costs are extra and at the customer's expense, unless otherwise mentioned on the site. ALME reserves the right to modify the price of its products at any time and without prior notice to the customer, in particular in the event of an obvious error (typography or printing) or a change in the VAT rate. The products ordered are invoiced to the customer on the basis of the price list in force on the site at the time the order is registered.

4. Control

All stages of the sale are clearly identified on the site in accordance with the provisions of Article 1369-1 of the Civil Code. In application of these provisions, the customer has the possibility to check the details of his order and its total price and to correct possible errors before definitively validating his order. The order is definitively registered only after validation by the customer of his payment agreement and acceptance by the bank of the transaction. The summary of the customer's order is available in printable version. As soon as the order is registered, the customer receives a confirmation e-mail containing the essential elements of the order, in particular the order number, the list of products ordered and the price details. All the data provided by the customer during the ordering process and the recorded confirmation of this order shall constitute proof of the transaction. ALME reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order as long as this dispute has not been resolved.

5. Payment

The payment of the purchases of the customer on the site www.almeparis.com is carried out by bank card. The accepted bank cards are the following ones: Credit card, Visa, Mastercard, Paypal and American Express. During the finalization of the order process, the customer is invited to enter his credit card number, the expiration date of his credit card as well as the last 3 digits of the visual cryptogram on the back of the card. Cheques are not accepted as a means of payment on the site www.almeparis.com. The details of the payment as well as the order number appear on the confirmation e-mail sent to the customer.

6. Measures against bank fraud

ALME reserves the right to verify the personal data provided by the customer and to adopt the measures it deems necessary (request for proof and/or cancellation of the order) to verify that the person whose bank account is debited is the one who placed the order and thus avoid any fraudulent use of bank card numbers on its site.

7. Payment security

For each product offered for sale, the customer has the option of paying by credit card by indicating his 16-digit card number, its expiration date and the visual cryptogram on the back of his card, depending on the type of card. The ordered products remain the property of ALME until the full payment of the invoice. The customer certifies that he/she has the necessary authorizations to make the payment by credit card. In the case of payment by credit card without authentication, the payment order may be repudiated in the event of fraudulent use of the card in accordance with the contract concluded between the customer and his banking establishment.

ALME delegates to BNP Paribas bank the use of encryption means to secure transactions in accordance with the legislation in force. Banking information is only transmitted to the BNP Paribas bank and is encrypted with SSL (Secure Socket Layer) 128 bits. In no case does ALME have knowledge of the customer's card number. The appearance of "https://..." in the address area and of a pictogram at the bottom of the customer's browser are proof accepted by the customer. Each payment by credit card is subject to an authorization request to the customer's bank. It is the latter that accepts or refuses the payment transaction.

The BNP Paribas payment interface uses 3D Secure technology. This is a system developed by the two bank card networks, Visa and MasterCard, to authenticate cardholders and thus prevent any fraudulent use of their cards. In addition to the number, the date of validity and the cryptogram, with the 3D Secure system, the cardholder must authenticate himself on an interface of his bank to which he is automatically redirected, by informing a code or a personal information that his bank will have transmitted to him beforehand. Once authenticated, the cardholder will see his transaction authorized or refused by his bank.

8. Delivery

Orders are delivered by La Poste and Colissimo to the delivery address entered by the customer, within an average of 4 working days. Deliveries can also be made to Point Relais by the service provider Mondial Relay, subject to acceptance of the parcel by the selected Point Relais. The customer is informed of the dispatch of his parcel by e-mail.

9. Withdrawal

The customer has a right of withdrawal of 14 days after receipt of the product.

To do this, the customer must return the new article(s) in their original packaging, intact, accompanied by all accessories, instructions and documentation as provided in the article RETURNS, to the following address

In this case, the customer can obtain a refund or an exchange of the product, at the latest within 14 days from the exercise of the right of withdrawal.
 

10. Returns

You have 14 days from receipt of your order to return any item (unworn, unwashed and with its original label) that is unsuitable, regardless of the delivery method chosen. During the holiday season, for all orders placed between December 1st and 23rd, the return period is extended to 1 month. Products must be returned intact, unused, in their original packaging and with the original label and any additional products offered with the order. For reasons of hygiene, items such as underwear and socks cannot be returned or exchanged. Products that have been worn, damaged, stained or returned in an obviously abusive manner will not be accepted. In this case, the parcel will be made available to the customer for 14 days. All risks associated with the return of the product shall be borne by Almé. Outside France, return costs are paid in advance by the customer and will be reimbursed up to a maximum of 6 euros, if the Mondial Relay service is not available in the country.

The refund of an order paid with a gift card will be automatically made in credit. Gift cards are neither exchangeable nor refundable.

Returns for jewelry are the responsibility of the customer.

To ensure delivery of the parcel, ALME recommends that the customer return the product by Colissimo Suivi (La Poste) with the "Contre signature" option. The customer will be reimbursed on the basis of the price of the invoiced product appearing on the order summary paid by the customer (excluding delivery costs), within an average of 14 working days, from the date of receipt of the parcel by ALME on the bank account that made the purchase.

  • In case of return of products of an order paid by 3 times, and if the verification of the products does not reveal any anomaly, it will be proceeded as follows:
  • In case of return of the totality of the products, the refund will be done on the totality of the drawn due dates and the unpaid due dates will be cancelled.
  • In case of return of a product on an order, the amount of future installments will be modified by deduction of the price of the returned product. Orders of 35 euros or less will not be eligible for free returns.

11. Transfer of ownership / Transfer of risk

The transfer of ownership of the products to the customer will be made only after full payment of the price by the latter, and this regardless of the date of delivery of the said products. On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out as of the delivery and the reception of the products by the customer.

12. Warranty

All products offered for sale on the www.almeparis.com website benefit from the legal guarantee against hidden defects provided for in articles 1641 and following, and article 1648 of the Civil Code. ALME undertakes to reimburse the customer or to exchange any apparently defective, spoiled or damaged product within 6 months following the date of receipt or withdrawal of the order by the customer.

In the event of an obvious error attributable to ALME, and in particular in the event of non-conformity of the products received with the products ordered (error in size, color, etc.), the customer must contact Customer Service, which will issue a prepaid label for the return (or exchange) of the non-conforming product received.

ALME reserves the right to refuse any request for reimbursement that is manifestly abusive or submitted outside the prescribed time limits.

13. Complaints / Information

For any information, complaint or question relating to these GCS or to the products offered for sale on the www.almeparis.com website, the customer is invited to contact ALME's Customer Service Department, - By e-mail [email protected], specifying the order number.

14. Responsibility

ALME cannot be held responsible:

  • For the non-execution of the contract in case of stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike in particular of the postal services and means of transport and/or communications;
  • Any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems;
  • The content of sites to which hyperlinks can be made from its own site.

15. Intellectual Property

All elements of the ALME website are and remain the exclusive intellectual property of ALME and SAS ALME. The customer is not authorized to reproduce, exploit, distribute, or use in any way whatsoever, even partially, the elements of the site, be they software, visual or sound.
 

16. Copyright

The texts, images, drawings and the layout of the site as well as the graphic charter of this site are protected by intellectual property law.

It is forbidden to copy, extract, distribute, modify or adapt the content of this site. The downloading and printing of text, images and graphics is permitted for private, non-commercial use only. The reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of ALME. The lack of authorization is sanctioned by the offence of counterfeiting.
 

17. Brands

The brands and logos appearing on the sites are registered and protected trademarks.

Any total or partial reproduction of these brands and/or logos, made from the elements of the site without the express authorization of the ALME company is constitutive of counterfeit sanctioned by articles L.335-2 and following of the Code of the intellectual property.

18. Data base

The databases established by ALME are protected by copyright as well as by the law of July 1, 1998 transposing the European directive of March 11, 1996 on the legal protection of databases into the Intellectual Property Code. Any extraction can only be limited and carried out for private purposes.

19. Hypertext links

Any simple link or hypertext link is strictly forbidden without the express written consent of ALME.

20. Personal Data

Consultation of the www.almeparis.com site does not require registration or identification with ALME. However, the registration data and IP addresses directly collected by the site www.almeparis.com during navigation on the site are processed in compliance with the principles of personal data protection defined by the legislation in force.

Insofar as ALME's Internet offer provides for the possibility of entering personal or business data, the provision of such data by the user is expressly on a voluntary basis. ALME expressly declares that the data will only be used for its own purposes and those of its business partners. All data will be treated confidentially in accordance with the applicable data protection regulations. In application of articles 38 to 40 of the law n° 78-17 of January 6, 1978, modified by the law n° 2004-801 of August 6, 2004, relating to data processing, files and freedoms, the User, or the Customer has a right of access, rectification, modification and deletion of the data which concern him.

21. Litigation

The present online GTC are subject to French law. Any dispute that cannot be settled amicably will be brought before the competent courts of the registered office of ALME.

22. Promotional codes

Promotional codes are issued for promotional and commercial purposes. They may be offered to our customers as part of marketing campaigns, special promotions or other similar initiatives.

Each promotional code is unique and can only be used once per order, unless explicitly stated otherwise.

Promotional codes may offer various benefits such as discounts on product prices, free shipping, or other similar advantages. The specific details of each promotional code, including their value and conditions of use, will be specified when they are issued.
